The Handling of Modification Proceedings
Parental relocation enables the other party to file for a motion for the modification of custody arrangements before court. In evaluating if such relocation demands the modification of custody or parenting time order, the court will have to consider the following factors:
- The difficulty on the other parent in observing the parenting time or visitation
- The distance between the old location and the new location
- The preservation of the other parent’s relationship with their child
- Any existing schedule observed by the relocation parent with other parent
- The relationship of the relocating parent with the other parent
- The grounds of the parent for the relocation
- The grounds of the non-relocating parent for his objection
- Other important considerations for the child’s best interests.
